Privacy Policy

This Privacy Policy explains how Perspective.je collects, uses, and protects your personal data. It has been written in accordance with the Data Protection (Jersey) Law 2018.

Please read this policy carefully before registering. By creating an account, you confirm that you have read and understood this policy.

1. Who We Are

Perspective.je is operated by:

Perspective.je is registered with the Jersey Office of the Information Commissioner (JOIC) as required by the Data Protection (Jersey) Law 2018.

2. What Personal Data We Collect

2.1 Account Registration Data

• First name and last name
• Email address
• Account credentials (password, stored as a secure hash)
• Date of birth — collected via a date picker at registration, used solely to verify that you are aged 16 or over and to automatically calculate your age band. Your date of birth is encrypted at rest in our database, is not displayed to you or any other user after registration, and cannot be changed via the Platform. See Section 12 for details of our security measures.

2.2 Demographic Data

The following demographic information is collected as part of your profile. It is optional at registration but required before you can submit answers to questions:

• Gender
• Parish of residence
• Income band
• Employment status

Your age band (for example, 16–24 or 25–34) is automatically calculated from your date of birth and is not entered manually.

2.3 Consent Records

We record whether you have accepted our Terms and Conditions, Privacy Policy, and given explicit consent to the collection of special category data. These records are stored against your account.

2.4 Survey Response Data

When you respond to a question, we record your answer together with a snapshot of your demographic information at the time of answering (age band, gender, parish, income band, and employment status). This snapshot is stored permanently as part of the aggregated response record. If you later update your demographic information, your previous responses retain the demographic snapshot from the time they were submitted. These snapshots cannot be retroactively modified or deleted, including upon account closure. They are retained as anonymised aggregated data with no link to your identity after your account is deleted.

Some questions may invite responses that include political opinions or religious and philosophical beliefs. These are classified as special category data under the Data Protection (Jersey) Law 2018 and are described further in Section 5.

2.5 Usage and Analytics Data

• Pages visited and time spent on the site
• Browser type and device information
• IP address (anonymised where possible)
• Referring website

3. How We Collect Your Data

• Directly from you when you register for an account
• Directly from you when you complete your profile
• Directly from you when you respond to questions
• Automatically through cookies and analytics tools when you browse our website
• Via third-party authentication providers (Google, Apple) if you choose to sign in using those services

4. Our Lawful Basis for Processing

4.1 Consent

We rely on your freely given, specific, informed, and unambiguous consent for:

• Processing special category data (political opinions, religious and philosophical beliefs) — collected via a separate explicit consent checkbox at registration
• Sending you daily question email notifications — you may withdraw this consent at any time via your account settings
• Setting non-essential cookies

You have the right to withdraw consent at any time. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

4.2 Contract

Processing is necessary to perform our contract with you for managing your account and enabling your participation in the Platform.

4.3 Legitimate Interests

We process certain data on the basis of our legitimate interests in operating and improving Perspective.je, including analytics data, maintaining system security, and age verification.

5. Special Category Data

Perspective.je collects responses to questions that may include political opinions and religious or philosophical beliefs. This is special category data under the Data Protection (Jersey) Law 2018 and is subject to stronger legal protections.

We only collect this data where you have given explicit, separate consent at registration — via a dedicated consent checkbox distinct from acceptance of our Terms and Conditions and Privacy Policy.

Your individual special category responses are never shared in a form that identifies you personally. We do not use your individual responses for profiling, targeting, or any commercial purpose.

6. Demographic Filtering and Re-identification

All registered users can view aggregated Results including demographic breakdowns by age band, gender, parish, income band, and employment status. Commercial Users additionally have access to Advanced Filtering, which allows multiple demographic filters to be applied simultaneously.

While Results are presented in aggregated form, filtering to a narrow combination of demographic criteria may produce results representing a small number of respondents. In such cases, there is a risk that responses within that cohort could be attributed to individuals, particularly where a demographic combination is unique within the current user base.

By registering and using Perspective.je, you acknowledge and accept that:

• Results may be filtered by other users in ways that narrow down to small cohorts
• Responses from small cohorts may carry a higher risk of attribution to individuals
• We do not enforce minimum sample size thresholds when displaying filtered Results

All users are strictly prohibited from using filtering or any other means to attempt to identify or re-identify individual respondents. This is a breach of our Terms and Conditions and may constitute a breach of the Data Protection (Jersey) Law 2018.

7. Cookies

• Essential cookies: Required for the website to function, including maintaining your login session. These do not require your consent.
• Analytics cookies: Used to collect anonymised data about how visitors use our site. These are only set with your consent.

8. How We Share Your Data

We do not sell your personal data to third parties. Survey responses are only ever shared externally in anonymised, aggregated form.

We share limited personal data with the following categories of third-party service providers, all of whom act as data processors under contract:

8.1 Database and Authentication Services

We use Supabase (Supabase Inc.) for database hosting, user authentication, and session management. Supabase processes your account data, authentication credentials, and survey responses in accordance with their Data Processing Agreement and is GDPR-compliant.

8.2 Email Service Provider

We use Resend (Resend Inc.) to send transactional emails including:

• Email verification messages
• Password reset emails
• Daily question notifications (if you have opted in)
• Account-related notifications

Resend processes your email address and first name for the sole purpose of delivering these emails. Resend is GDPR-compliant and operates under a Data Processing Agreement that requires them to process data only on our instructions and in compliance with applicable data protection law, including the Data Protection (Jersey) Law 2018.

8.3 Legal Disclosures

We may share personal data with public authorities or law enforcement where we are legally required to do so under Jersey law or by court order.

9. International Data Transfers

Your data is primarily stored and processed within Jersey or the United Kingdom. Jersey has been recognised by the European Commission as providing an adequate level of data protection. Any transfers outside these jurisdictions will only occur with appropriate safeguards in place.

10. How Long We Keep Your Data

• Account data: Retained while your account is active. Upon account deletion, your personal data is removed. A 30-day grace period applies before permanent deletion is processed.
• Survey response data: Demographic snapshots stored with your responses are retained as anonymised aggregated data after account deletion, in a form that cannot be linked back to you. This is necessary to preserve the integrity of historical Results.
• Analytics data: Retained for up to 26 months.
• Communication records: Retained for up to 3 years.
• Consent records: Retained for the duration of your account and for a reasonable period thereafter as evidence of lawful processing.

11. Your Rights

Under the Data Protection (Jersey) Law 2018 you have the right to:

• Access — request a copy of your personal data
• Rectification — ask us to correct inaccurate data
• Erasure — ask us to delete your personal data
• Restriction — ask us to restrict how we use your data
• Data portability — request your data in a machine-readable format
• Object — object to processing based on legitimate interests
• Withdraw consent — withdraw consent at any time

To exercise any of these rights, contact us at hello@perspective.je. We will respond within one calendar month.

Please note that the right to erasure does not extend to anonymised aggregated response data retained after account deletion, as this data cannot be linked to you individually.

12. Security of Your Data

We implement appropriate technical and organisational measures to protect your personal data, including:

• HTTPS encryption for all data in transit
• Secure password hashing
• Row-level security controls on our database
• Date of birth encrypted at rest using AES-256 symmetric encryption. Decryption occurs only within secure database functions for the purpose of age band calculation and is never exposed to the application layer or to any user.
• Access controls limiting data access to authorised personnel and functions only

In the event of a data breach likely to result in risk to your rights and freedoms, we will notify the JOIC within 72 hours and affected users without undue delay.

13. Age Restriction

Perspective.je is open to users aged 16 and over. We collect your date of birth at registration to verify this requirement. We do not knowingly collect personal data from anyone under the age of 16. If you believe a person under 16 has provided us with personal data, please contact us at hello@perspective.je.

15. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date and, where changes are significant, notify registered users by email.

Terms and Conditions

Please read these Terms and Conditions carefully before using Perspective.je. By registering for an account or using this platform, you agree to be bound by these terms. If you do not agree, you must not use Perspective.je.

1. About Perspective.je

Perspective.je is a Jersey-based public opinion platform that puts questions to registered users and collects their responses. Aggregated results are made available to all registered users. Advanced demographic analysis features are available to Commercial Users.

2. Definitions

• Platform — the Perspective.je website and associated services at perspective.je
• Public User — any individual who registers for a free account to participate in surveys and view Results
• Commercial User — any business, organisation, journalist, researcher, or public body that has been granted a Commercial User account to access advanced features of the Platform
• Content — any responses, answers, or information submitted by a user
• Results — the anonymised, aggregated data compiled from Public Users' responses
• Advanced Filtering — the multi-variable demographic filtering feature available exclusively to Commercial Users, which allows filtering of Results by multiple demographic categories simultaneously

3. Eligibility and Account Registration

3.1 Age requirement

You must be at least 16 years of age to register. You will be required to provide your date of birth at registration, which we use to verify that you meet this requirement. We reserve the right to terminate accounts where we believe a user is under 16.

3.2 Account registration

You must provide accurate, complete, and up-to-date information. You are responsible for keeping your credentials secure, all activity under your account, and notifying us immediately at hello@perspective.je if you suspect unauthorised use.

You may only hold one account. Creating multiple accounts to inflate or manipulate survey responses is strictly prohibited.

3.3 Commercial User accounts

Commercial User accounts are currently available on an invite-only basis and are provisioned manually by Perspective.je. There is no self-service registration for Commercial Users at this time. To enquire about Commercial User access, contact hello@perspective.je.

Commercial User accounts are non-transferable. We reserve the right to introduce fees for Commercial User access in the future, at which point existing Commercial Users will be given reasonable notice.

4. Public Users — Free Accounts

Public Users may, free of charge:

• Register for an account on the Platform
• Participate in questions and surveys
• View aggregated, anonymised Results including demographic breakdowns by age, gender, parish, income band, and employment status

Public Users may not:

• Access Advanced Filtering features
• Publish or commercially exploit Results without a Commercial User account
• Scrape, download, or systematically extract data from the Platform
• Attempt to identify or re-identify individual respondents from Results or demographic data (see Clause 6)

5. Commercial Users

5.1 Who this applies to

Commercial User accounts are available to businesses, journalists, media organisations, researchers, academics, government bodies, and public authorities who wish to access advanced features of the Platform.

5.2 Current access model

Commercial User accounts are currently provisioned on an invite-only basis at no charge. Access to Commercial User features, including Advanced Filtering, is granted at the discretion of JLEC Limited.

We reserve the right to introduce fees for Commercial User access in the future. Where fees are introduced, Commercial Users will be given reasonable advance notice and access will not be revoked without an opportunity to agree terms.

5.3 Licence to use Results

We grant Commercial Users a limited, non-exclusive, non-transferable licence to access, view, and publish Results, provided Perspective.je is clearly credited as the source.

This licence does not permit Commercial Users to:

• Sell or sub-licence Results to third parties
• Present Results in a misleading or inaccurate manner
• Imply endorsement by Perspective.je
• Attempt to re-identify individual respondents from Results or filtered data
• Use Results in breach of applicable law, including data protection law

5.4 Attribution

When publishing Results, Commercial Users must attribute data to Perspective.je clearly and prominently. Attribution must not be removed, obscured, or altered.

6. Acceptable Use

All users agree not to:

• Provide false, misleading, or fraudulent information
• Submit responses on behalf of another person without their consent
• Use automated tools, bots, or scripts to submit responses
• Attempt to gain unauthorised access to any part of the Platform
• Use the Platform in any way that is unlawful, harmful, abusive, or defamatory
• Attempt to reverse engineer, copy, or reproduce any part of the Platform
• Interfere with the operation or integrity of the Platform
• Infringe the intellectual property rights of any person
• Attempt to identify or re-identify any individual respondent through the use of demographic filtering, cross-referencing of Results, or any other means. This prohibition applies to all users including Commercial Users and constitutes a serious breach of these Terms and may constitute a breach of the Data Protection (Jersey) Law 2018

7. Your Content and Responses

Your individual responses are linked to your account for internal purposes only and will never be publicly attributed to you personally.

By submitting responses, you grant us a perpetual, royalty-free licence to use and include your responses in anonymised, aggregated Results. This licence survives termination of your account.

When you submit a response, your current demographic information (age band, gender, parish, income band, and employment status) is permanently recorded alongside that response as a snapshot at the time of answering. This snapshot is retained as part of the anonymised aggregated record even if you later update your demographic information or close your account. See our Privacy Policy for full details.

You confirm your responses are your genuine, honest opinions and that you have not been paid or coerced to provide particular responses.

8. Sensitive Survey Questions

Some questions may relate to political opinions or religious and philosophical beliefs, classed as special category data under the Data Protection (Jersey) Law 2018. At registration, you will be asked to provide explicit, separate consent to the collection of this type of data. Your participation in any individual question is entirely voluntary. You may decline to answer any question at any time without consequence to your account.

9. Enforcement and Account Suspension

If we believe a user has breached these Terms, we reserve the right to issue a warning, temporarily suspend access, permanently terminate the account, remove fraudulent responses, or take legal action where appropriate.

We will endeavour to act fairly and proportionately in all cases.

10. Intellectual Property

All intellectual property rights in the Platform — including its design, software, content, and branding — are owned by or licensed to JLEC Limited. The Results produced by Perspective.je are our intellectual property. You must not reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.

11. Disclaimers

Perspective.je is provided on an "as is" and "as available" basis. We make no warranties regarding the accuracy, completeness, or reliability of the Platform or its Results.

Survey Results represent the aggregated opinions of registered users at the time of collection and should not be treated as statistically representative of the wider population of Jersey unless stated otherwise.

12. Limitation of Liability

To the fullest extent permitted by law, JLEC Limited shall not be liable for any indirect, consequential, or incidental loss arising from use of the Platform, including loss of profits, data, or business opportunity, or any loss arising from reliance on Results.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

13. Privacy and Data Protection

Your use of Perspective.je is governed by our Privacy Policy. By using the Platform, you confirm you have read and understood our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. For significant changes, we will notify registered users by email with reasonable notice. Your continued use of the Platform after any changes constitutes acceptance of the updated Terms.

15. Termination

You may close your account at any time via your account settings or by contacting us at hello@perspective.je. We reserve the right to suspend or terminate your account if we reasonably believe you have breached these Terms. Termination does not affect the licence granted over anonymised, aggregated Content, which is retained as part of the Results record.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of Jersey. Any disputes shall be subject to the exclusive jurisdiction of the courts of Jersey.
